In an ideal world, child custody will be settled amicably by the parents, taking into consideration the parenting skills of each parent, and the best interest of the child.
However, in reality, parents often have pretty significant reasons for getting divorced. Sometimes these reasons revolve around one spouse trying to protect the children from the other spouse. Domestic violence, of course, is one primary reason. But, in addition to that, there are verbally abusive parents, emotionally abusive parents, sexually abusive parents, parents addicted to drugs or alcohol, uncaring or involved parents, inept parents, depressed parents, narcissistic parents, parents who take up with an undesirable significant other, parents experiencing a change in sexual orientation and parents who try to alienate the child(ren) from the other parent. We have achieved successful results in all of the above situations.
Litigating a custody/visits case can be expensive. However, these costs have to be weighed against the benefits that can be obtained. What is expensive is when clients come to us after they tried to save money by using a less experienced attorney. Then we have to try to undo the damage, which is a difficult and costly endeavor.
If protecting your child(ren) is one of your main concerns, you need an advocate who can turn the system to your advantage. You need a skilled litigator who can expose the falsehoods of the other party, and work with your witnesses and documentation to create a solid case for the truth. Family Alzayat Law Firm excels at presenting to custody evaluators and the judge the type of evidence they need to decide in your favor. We also have achieved good results defending parents from erroneous allegations.
It is important to see us as early as possible in a contested custody/visitation case. We do charge for the first consultation. But you will get much better information and advice in that first hour than you will get from most attorneys over an entire case. According to family law in Egypt the child custody stays with women until the child reaches fifteen years of age, for both boys and girls, then, if the father asked the judge for custody the judge will give the child the choosing staying with his mother or his father until the girl marry and the boy reach to age twenty-one years old.
The reasons that lead to revoking the right of the custody to the mother:
1. The mother is a prostitute.
2. The mother has a dangerous communicable illness.
3. The mother will try to change the child's religion by affecting his beliefs.
4. The mother cannot take care of the child because of her work.
Legally speaking, the mother is qualified for custody and if anyone has anything else to say will have to take legal action against her to prove it, and it is up to the judge to decide it.
The Egyptian family law considers that custody is a right for the child so Even If this happens the court may cancel this agreement for the interest of the child.
